These Terms and Conditions (In conjunction with the links provided within these terms, particularly our Privacy Policy) sets out the terms and conditions on which M&BT Investments Pty Ltd (‘The Company’ – ABN 29 577 433 738] (‘Portions’. ‘us’, ‘we’ or ‘our’) will supply to you (the ‘customer’) the products listed on our website, www.portions.com.au (Website).
By accessing and/or using our website and services, you agree to the following Terms and Conditions, inclusive of our Privacy Policy. You should review our Terms and Conditions and Privacy Policy thoroughly before ordering any products from our website or utilising any of our services. If you do not agree with these Terms or our Privacy Policy, immediately cease using our website. By continuing to use our website, and/or ordering our products, you confirm that you have read and agree to our Terms and Conditions and Privacy Policy.
Portions reserves the right to update and make changes to portions.com.au website and the Terms and Conditions at any time. It is the responsibility of the customer to ensure they have read, understood and agree to these changes and Terms. Portions is run and operated by mother company M&BT Investments Pty Ltd. M&BT Investments Pty Ltd and portions.com.au are an Australian owned and based family business, at current, operate only within Australia. All amounts and prices are in Australian Dollars (AUD), inclusive of GST (Goods & Services Tax) unless specified otherwise.
Liability of Portions
To the maximum extent permitted by law, including the Australia Consumer law, we reserve the right to make no warranties or representations of the website or its contents. This includes but is not limited to warranties and representations that the information provided on our website is accurate, complete and up to date. Also, that its contents won’t be error free, access interrupted, free from viruses or that the website is secure.
It is of Portions liability to
– Provide customers with correct purchases.
– Provide true information regarding product ingredients, storage, handling and heating.
– Provide true labelling and description of products.
– Treat your personal information with security and respect.
Portions will not be liable for any direct and or indirect loss, damage or expenses experienced or suffered due to the use of our website, products or services. This includes but is not limited to any information or material listed on our website, any additional costs incurred with delivery or pick up or due to consumption of our products.
We reserve the right to suspend, terminate or restrict your access to our website, it’s contents, features and information at anytime without notice and will not be liable for any loss, damages or costs incurred.
Liability of customer
It is of the customers liability to
– Provide true and correct information
– Have read and agreed with our Terms and Conditions and Privacy policy before continuing to use our website and purchase and products from our website.
– Be of age, 18 years old and over or seek parental approval to make a purchase
– Provide and use true payment information
Portions reserves the right to refuse service to any customer at our discretion.
Delivery
Portions delivery network currently ranges to a 40km radius of Burwood, Vic, 3125 which has been set at our discretion and deliveries outside of this will be on a case by case basis.
Portions offers free delivery with a minimum spend of $89.00 to certain locations, you can check this here –
If you do not fall within the free delivery area, you will be charged a set rate of $10.00 for delivery with the minimum spend of $89.00
Portions reserves the right to refuse deliveries to PO Boxes and alternative addresses.
Deliveries will be made between the hours of 6am – 6pm and ringing/knocking on a door will be at the discretion of the driver. Should they deem it not suitable to knock or ring a doorbell at a reasonable time, they will leave the delivery in a safe location.
At the discretion of our driver, if they deem the delivery address not safe, they’re unable to gain access to the property and or there are no delivery instructions, the delivery will be returned back to Portions main manufacturing kitchen and it is then the responsibility of the customer to organise a collection of the delivery from the Kitchen by contacting eatsmart@portions.com.au.
If a delivery fee has been paid for the order, the customer is not entitled to a re-delivery or refund of the delivery fee.

Pick up
Portions reserves the right to only offer delivery to certain locations. Customer may opt for Burwood kitchen pick up, otherwise orders that do not meet the minimum spend or fall outside our delivery scope must be collected from the Kitchen location in Burwood at 7 Florence Street on the allocated pick up day between the hours of 9am to 5pm AEST.
Positions is not liable for any further cost incurred to the customer for pick up. This includes but is not limited to, fuel, car and fine costs.
Portions reserves the right to provide meals as they are, individually packaged upon pick-up. We will not be liable for any damages incurred to meals after pick-up. It is the responsibility of the customer to provide a suitable carry bag/storage container to hold frozen/fresh meals on pick-up.
Cancellations
Portions reserves the right to refuse any cancellations made less than 48 hours prior to the orders delivery day due to the nature of our meals, production and packing.
E.g. for deliveries made on a Tuesday, cancellations made after 12am Sunday may not be considered.
Order cancellations must be emailed to eatsmart@portions.com.au. Your email must include your name, order number, contact email, number, address and reason for cancelation.
Returns & Refunds
Portions will accept returns and refund requests whereby there has been an error made on our end. This includes, incorrect pick of order, system error and or delivery error made by our staff.
Portions reserves the right to refuse return or refund requests if it has not been the fault of portions. This includes, but is not limited to, the customer providing the incorrect information, and or the customer making an incorrect purchase.
1. Whilst you are not required to be home to receive a delivery, it is of the customers responsibility to ensure the delivery address is suitable to receive the delivery safely should the property be unattended. Customers must include delivery instructions in the special instructions section in checkout should they live at a gated property or where by their front door is not safe for the delivery to be left.
2. At the discretion of our driver, if they deem the delivery address not safe, they’re unable to gain access to the property and or there are no delivery instructions, the delivery will be returned back to the kitchen and it is the responsibility of the customer to organise a collection of the delivery from the Kitchen by contacting eatsmart@portions.com.au. If a delivery fee has been paid for the order, the customer is not entitled to a re delivery or refund of the delivery fee.
Portions reserves the right to use their discretion in other circumstances where a return and/or refund has been requested which should be sent in an email to eatsmart@portions.com.au which will need to include your email, name, order number, contact email, contact number, address and reason for refund or return.

Discount Codes
Only 1 discount code per purchase. Discount codes can not be added to a purchase after a transaction has been completed. Customers must enter in their discount code correctly before submitting their payment. The cart will automatically calculate the new charge.
